This page contains placeholder business details that must be replaced with real information, and should be reviewed by a solicitor, before it goes live.
1. Who we are
These Terms of Service ("Terms") govern your use of Forago, an online marketplace operated by [PLACEHOLDER: Legal entity name, e.g. "Forago Ltd, a company registered in England and Wales (Company No. 00000000)"], of [PLACEHOLDER: Registered/contact postal address] ("Forago", "we", "us"). These Terms apply to anyone who creates an account or otherwise uses the site as a customer.
If you're applying to sell on Forago, separate Seller Terms of Service also apply to you in addition to these Terms.
2. Acceptance of these terms
By creating an account, browsing, or placing an order on Forago, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the site.
3. Your account
You must be at least 18 years old to create an account. You agree to provide accurate information, keep your login details secure, and let us know if you believe your account has been compromised. You're responsible for activity that happens under your account.
4. Forago's role as a marketplace
Forago is a marketplace that connects independent food makers ("sellers") with customers. Each shop on Forago is operated by an independent business, not by us. When you place an order, you enter into a contract directly with the seller for the supply of that product — Forago is not the seller and is not a party to that contract, except where we say otherwise.
We're responsible for operating the marketplace platform, processing payments, and handling the matters set out in these Terms — but day-to-day matters like product quality, accuracy of listings, dispatch and order fulfilment are the seller's responsibility.
5. Placing an order
Prices, availability and delivery options are set by individual sellers and may change at any time before you complete checkout. An order is only confirmed once you receive an order confirmation; this confirmation is acceptance of your order by the seller, not by Forago.
6. Payment
Payment is taken at checkout via our payment provider. We take reasonable steps to keep payment processing secure, but we are not responsible for issues caused by our third-party payment provider.
7. Delivery and collection
Delivery and click & collect timescales are estimates provided by each seller and are not guaranteed by Forago. Delivery methods, costs and coverage vary by seller and are shown at checkout.
8. Cancellations, returns and refunds
Many products sold on Forago are fresh, perishable, made-to-order, or have a short shelf life. Under the Consumer Contracts Regulations 2013, the standard right to cancel an online order within 14 days does not apply to goods that are made to your specification, are personalised, or are liable to deteriorate or expire rapidly. Where this exception doesn't apply, standard cancellation rights apply instead.
Individual sellers may also publish their own returns and cancellation policy on their shop page. If an order arrives faulty, damaged or not as described, contact the seller in the first instance, or contact us if you're unable to resolve it directly.
9. Allergens and dietary information
Dietary and allergen information shown on Forago is provided by sellers and is intended as a guide to help you filter and choose products. If you have a food allergy or intolerance, especially a severe one, always check with the seller directly before ordering — on-site filters and labels are not a substitute for direct confirmation from the people making your food.
10. Acceptable use
You agree not to:
- Use the site for any unlawful purpose, or in a way that could damage, disable or impair it;
- Post abusive, defamatory, or fraudulent content (including fake reviews);
- Attempt to circumvent the marketplace to avoid fees owed by sellers to Forago;
- Attempt to access another user's account or our systems without authorisation.
11. Intellectual property
The Forago name, logo and site design belong to us. Product names, descriptions, images and shop content belong to the relevant sellers. You may not copy or reuse this content without permission.
12. Liability
To the extent permitted by law, Forago is not liable for the acts or omissions of sellers, including the quality, safety, legality or accuracy of listings or products. Nothing in these Terms limits any liability that cannot legally be limited, such as for death, personal injury caused by negligence, or fraud.
13. Suspending or closing your account
You can close your account at any time by contacting us. We may suspend or close an account that breaches these Terms, or where we reasonably believe it's necessary to protect the marketplace, other users, or sellers.
14. Changes to these terms
We may update these Terms from time to time. If we make significant changes, we'll let registered users know by email or via a notice on the site. Continuing to use Forago after a change takes effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Contact us
If you have any questions about these Terms, contact us at [PLACEHOLDER: Contact email, e.g. "hello@forago.co.uk"], or via our contact page.
